On November 14, 2024, Smartsheet, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York on behalf of a class (“Class”) consisting of all individuals and entities that were Smartsheet stockholders of record as of the close of business on October 25, 2024 (the record date in the Proxy) (“Class Period”).

On November 14, 2024, ASML Holding N.V. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York on behalf of investors who purchased or otherwise acquired ASML ordinary shares on the Nasdaq Stock Market (the “Nasdaq”) between January 24, 2024, and October 15, 2024, inclusive (the “Class Period”).

On November 1, 2024, Flux Power Holdings, Inc. was sued for violations of the federal securities laws in the United States District Court for the District of Nevada on behalf of investors who purchased or otherwise acquired publicly traded Flux Power securities between November 11, 2022 and September 30, 2024, inclusive (the “Class Period”).

On October 17, 2024, WM Technology, Inc. was sued for violations of the federal securities laws in the United States District Court for the Central District of California on behalf of investors who purchased or otherwise acquired publicly traded WM Technology, Inc. securities, between May 25, 2021, and September 24, 2024, inclusive (the “Class Period”).

On October 16, 2024, Acadia Healthcare Company, Inc. was sued for violations of the federal securities laws in the United States District Court for the Middle District of Tennessee on behalf of investors who purchased or otherwise
acquired publicly traded Acadia Healthcare securities between February 28, 2020 and September 26, 2024 inclusive (the “Class Period”).   The complaint was subsequently amended to include investors who purchased or otherwise
