Recent Security Class Actions

On October 4, 2023, Emisphere Technologies, Inc. was sued for violations of the federal securities laws in the United States District Court for the District of New Jersey on behalf of investors who sold shares of the publicly traded
common stock of Emisphere Technologies, Inc. (“Emisphere” or the “Company”) from November 6, 2020, the announcement date of the merger (“Merger”) between Emisphere and Novo Nordisk A/S (“Novo Nordisk” or “Novo”), through the close of the Merger on December 8, 2020, (the “Class Period”), including investors who sold their shares of Emisphere common stock into the Merger on December 8, 2020.

On October 4, 2023, GigaCloud Technology Inc. was sued for violations of the federal securities laws in the United States District Court for the Central District of California on behalf of investors who purchased or otherwise acquired GigaCloud: (a) Class A ordinary shares pursuant and/or traceable to the registration statement and prospectus (collectively, the “Registration Statement”) issued in connection with the Company’s August 2022 initial public offering (“IPO” or the “Offering”); and/or (b) securities between August 18, 2022 and September 27, 2023, inclusive (the “Class Period”).

On September 29, 2023, PureCycle Technologies, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York  on behalf of investors who purchased or otherwise
acquired PureCycle securities between August 8, 2023 and September 13, 2023, inclusive (the “Class Period”).

On September 29, 2023, Medical Properties Trust, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York  on behalf of investors who purchased or otherwise acquired MPW securities between May 23, 2023 and August 17, 2023, both dates inclusive (the “Class Period”).

On September 21, 2023, Archer Aviation, Inc. was sued for violations of the federal securities laws in the United States District Court for the Northern District of California on behalf of investors who purchased or otherwise acquired Archer securities between September 17, 2021 and August 15, 2023, both dates inclusive (the “Class Period”).

On September 19, 2023, CS Disco, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York  on behalf of investors who purchasedshares of CS Disco’s common stock between July 21, 2021, and August 11, 2022, inclusive (the “Class Period”).

On September 15, 2023, Lumen Technologies, Inc. was sued for violations of the federal securities laws in the United States District Court for the Western District of Louisiana on behalf of investors who purchased or otherwise acquired Lumen securities between March 11, 2019 and July 14, 2023, both dates inclusive (the “Class Period”).

On September 13, 2023, Myovant Sciences, Ltd. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York on behalf of investors that were Myovant common shareholders of record as of the close of business on January 20, 2023 (“Class Period”), which was the record date for determining the Minority Myovant Shareholders entitled to vote on the Merger.

On September 12, 2023, Integra LifeSciences Holdings Corporation was sued for violations of the federal securities laws in the United States District Court for the District of New Jersey on behalf of investors who purchased or otherwise acquired shares of Integra common stock between March 11, 2019 and May 22, 2023, inclusive (the “Class Period”).

On September 12, 2023, DigitalOcean Holdings, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York  on behalf of investors who purchased or otherwise acquired DigitalOcean Holdings, Inc. (“DigitalOcean” or the “Company”) securities between February 16, 2023, and August 25, 2023, inclusive (the “Class Period”).

On September 12, 2023, Enviva, Inc. was sued for violations of the federal securities laws in the United States District Court for the District of Maryland on behalf of investors who purchased or otherwise acquired Enviva common stock on a U.S. open market during the class period November 3, 2022 through May 3, 2023, both dates inclusive (the “Class Period”).

On September 11, 2023, PacWest Bancorp was sued for violations of the federal securities laws in the United States District Court for the Central District of California on behalf of investors who purchased or otherwise acquired PacWest securities between February 28, 2022 and May 3, 2023, inclusive (the “Class Period”).

On September 8, 2023, Tandem Diabetes Care, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of California on behalf of investors who purchased or otherwise acquired Tandem securities between August 3, 2022 and November 2, 2022 inclusive (the “Class Period”).

On September 8, 2023, Leslie’s, Inc. was sued for violations of the federal securities laws in the United States District Court for the District of Arizona on behalf of investors who purchased Leslie’s common stock between February 5, 2021 and July 13, 2023, inclusive (the “Class Period”).

On September 6, 2023, UiPath Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of New York  on behalf of investors who purchased the Company’s shares between April 21, 2021 and March 30, 2022, inclusive (the “Class Period”).

On September 1, 2023, Discover Financial Services was sued for violations of the federal securities laws in the United States District Court for the Northern District of Illinois on behalf of investors who purchased or otherwise acquired DFS common stock between February 21, 2019 and August 14, 2023, both dates inclusive (the “Class Period”).

On August 31, 2023, MaxLinear, Inc. was sued for violations of the federal securities laws in the United States District Court for the Southern District of California on behalf of purchasers of the American Depositary Shares (“ADSs”) of Silicon Motion from June 6, 2023 through July 26, 2023, inclusive (the “Class Period”). This case arises out of defendants’ omission of material facts in connection with public statements made by defendants concerning the MaxLinear and Silicon Motion Merger.

On August 30, 2023, AeroVironment, Inc. was sued for violations of the federal securities laws in the United States District Court for the Eastern District of Virginia on behalf of investors who purchased or otherwise acquired AeroVironment securities between June 29, 2021 and December 7, 2021, inclusive (the “Class Period”).

On August 29, 2023, NAPCO Security Technologies, Inc. was sued for violations of the federal securities laws in the United States District Court for the Eastern District of New York  on behalf of investors who purchased or otherwise
acquired publicly traded NAPCO securities between November 7, 2022 and August 18, 2023, inclusive (the “Class Period”).

On August 25, 2023, Origin Materials, Inc. was sued for violations of the federal securities laws in the United States District Court for the Eastern District of California on behalf of investors who purchased or otherwise acquired Origin securities between February 23, 2023, and August 9, 2023, inclusive (the “Class Period”).
