Mylan N.V. Fair Fund Update

In a separate enforcement action case, Securities and Exchange Commission v. Mylan N.V., No. 19-cv-2904, D.D.C., the S.E.C. has established a Fair Fund in the amount of $30,000,000 for investors who purchased or otherwise acquired Mylan N.V. common stock (“MYL”) between March 2, 2015 and September 1, 2016. Investors who acquired shares of Mylan common stock in the June 2016 share exchange in connection with Mylan’s acquisition of Meda Aktiebolag may be eligible for a recovery from the Fair Fund.

The Court created a Fair Fund (the “Mylan Fair Fund” or “Fair Fund) by Order dated February 19, 2020 to distribute the civil money penalties paid by Mylan to harmed investors in accordance with the terms of the Distribution Plan approved by the Court on August 17, 2021.
